1 The State appeals an order dismissing with prejudice its complaint against Rey Palop, who was charged with eleven counts of obtaining a controlled substance by fraud as party to a crime, contrary to WIS. STAT.§§ 961.43(1)(a) and 939.05 (2001-02). The State contends Palops motion to dismiss based on insufficiency of the complaint was untimely. We agree and accordingly, we reverse the order.
